INTRODUCTION FEES
Remuneration package up to £15,000 15%
Remuneration package in excess of £15,000 20%

Where we are instructed to carry out a retained search, our fees will not be subject to the above and will be subject to agreement between us and are payable as follows:

Retainer Fee 1/3 payable on acceptance of assignment;
Shortlist Fee 1/3 payable on presentation of a suitable shortlist of Applicants;
Completion Fee 1/3 payable on signed acceptance of offer of engagement.

In the event that the Engagement is for a term of less than 12 months, the Introduction Fee will be calculated on a pro rata basis for the period of the engagement.

All fees are expressed as a percentage of the first year’s gross annual Remuneration package and are subject to VAT at the standard rate at time of operation.

All fees are payable within 21 days of issue of Invoice;

These Terms and Conditions are deemed accepted by the Client by virtue of an Introduction to, or Engagement of, an Applicant.

TERMS AND CONDITIONS OF BUSINESS
1. These terms and conditions of business which constitute a Contract are between Lesters Financial Recruitment (hereinafter called “the Company”) and the Employer (hereinafter called “the Client”) for the introduction of Staff (whatever the basis of engagement) and are deemed accepted by the Client by virtue of an Engagement by the Client of an Applicant (the person introduced by the Company to the Client) introduced by the Company or by the passing of any information about the Applicant to any third party following an Introduction.
Introduction in this agreement means the Clients interview of an Applicant in person or by any other means arising out of the Clients instructions to the Company or the passing to the Client of a Curriculum Vitae of information which identifies the Applicant.

2. These terms contain the whole agreement and can only be varied by written agreement between the parties to the agreement.

3. NOTIFICATION AND FEES
Client agrees to notify the Company immediately an offer of engagement is made to the Applicant.
Client agrees to notify the Company that an offer of engagement has been accepted by the Applicant and the terms of remuneration agreed.

The Client agrees to settle the Company’s Invoice within 21 days of issue.
The Introductory fees payable to the Company are as follows: Remuneration in the following context means base salary or fees, any anticipated bonus or dividend, commission payments, and benefits of a Company Car and any other benefits receivable by the Applicant. For this purpose, the provision of a Company Car will be taken to be worth £5000.

Remuneration package up to £14,999 15%
Remuneration package of between £15,000 and £74,999 20%
Remuneration package in excess of £75,000 25%

All fees are expressed as a percentage of the first year’s gross annual Remuneration package.
VAT at standard rates is payable on all fees and charges.

4. REFUNDS
In the event that an Applicant terminates, or the Client terminates, the Engagement within 8 weeks from the time that the Engagement commenced and provided:

i. That the Client notifies the Company in writing of the termination of the Engagement within 7 days of the event happening;
ii. That the Client has settled all Invoices due to the Company;
iii. The Company will endeavour to seek a replacement at no additional cost and in the event that this is not possible, the following rebates of the fee will apply:

Up to 4 weeks termination of engagement 75% of fee
Between 4 and 6 weeks termination of engagement 50% of fee
Between 6 and 8 weeks termination of engagement 25% of fee
No rebate applies after 8 weeks service with the Client.

SUITABILITY AND REFERENCES
The Company endeavours to ensure the suitability of any Applicant introduced to the Client by obtaining confirmation of their identity and that they have the experience, training, qualifications and any other authorisation which the Client considers necessary or which may be required by law or by any professional body.
Notwithstanding the above, the Client shall satisfy himself as to the suitability of the Applicant and the Client shall take up any references provided by the Applicant to it or the Company before engaging such Applicant. The Client is responsible for obtaining work permits and or such permissions to work may be required.

LIABILITY
The Company shall not be liable under any circumstances for any loss, expense, damage, delay, costs or compensation (whether direct, indirect or consequential) which may be suffered by the Client arising from or in any way connected with the Company seeking an Applicant for the Client or from the introduction to or Engagement of any Applicant by the Client or from failure of the Company to introduce any Applicant.
